What Drivers Need to Know About This Week’s National Drive Sober Crackdown

Federal and state police have added extra patrols on US roads through Labor Day, part of an annual crackdown that puts more officers on the lookout for impaired drivers over the year’s busiest travel weekend.

The National Highway Traffic Safety Administration launched its Drive Sober or Get Pulled Over campaign on August 18, with law enforcement agencies nationwide running increased patrols from August 19 through Labor Day, September 7. A national ad campaign featuring TV, radio and social media runs on the same schedule.

The Numbers Behind the Crackdown

NHTSA built this year’s push around a grim statistic: in 2024, an alcohol-impaired driver killed someone on a US road once every 44 minutes. Drunk driving accounted for 30 percent of all US traffic deaths that year, 11,904 lives lost. Alcohol-impaired deaths did drop nearly 4 percent compared with 2023, but NHTSA Administrator Jonathan Morrison called even that improvement far from good enough.

“Law enforcement officers nationwide are increasing enforcement to take dangerous drivers off the road and save lives,” Morrison said. “Nearly 12,000 lives were lost in 2024… leaving behind families and communities who will never be the same.”

The data show the risk is not spread evenly. Men between 21 and 34 make up the largest single group of alcohol-impaired drivers involved in fatal crashes. Crashes involving an impaired driver happen at a rate three times higher at night than in daylight hours, which is part of why Labor Day weekend, with its evening cookouts, tailgates and late drives home, draws this level of enforcement every year.

What Extra Patrols Actually Look Like

Increased enforcement over Labor Day weekend generally means more officers on the road, more sobriety checkpoints where state law allows them, and in some jurisdictions, “no-refusal” enforcement that removes a driver’s ability to decline a breath or blood test without consequence. Departments running no-refusal operations keep an on-call judge and phlebotomist available so officers can get a warrant for a blood draw within the same shift if a driver refuses a breathalyzer.

State police in Connecticut, Wisconsin, Texas and Utah are among those that have publicized stepped-up Labor Day patrols this year, and local departments across the country are running similar operations under the national campaign umbrella. Checkpoint locations and schedules vary by state and county, and not every state allows sobriety checkpoints at all. A dozen states, including Texas, prohibit checkpoints outright and rely instead on roving patrols and probable-cause stops.

Penalties for a first-offense DUI vary sharply by state. Some states charge a first offense as a basic misdemeanor with a modest fine and license suspension. Others have moved toward tougher automatic consequences in recent years, including mandatory ignition interlock devices after a first conviction and longer administrative license suspensions for drivers who refuse a chemical test. A refusal itself can trigger a suspension in most states even without a DUI conviction, separate from any criminal penalty that follows.

The Campaign’s Public Face

NHTSA marked the campaign’s kickoff at the US Department of Transportation with an event built around personal loss rather than statistics alone. Ebbony and Raymond Jackson, parents of NFL-drafted football player Khyree Jackson, who was killed by a drunk driver in 2024, joined Morrison at the launch. A roundtable discussion brought together Urban Meyer, Mark Ingram II, Rob Stone, Jerry Ferrara and a retired South Dakota Highway Patrol major, alongside a sobriety simulator demonstration and a “Pledge to Drive Sober” signature wall.

NHTSA is also sending a Sober Driving Pledge Tailgate Tour to college football games through the fall season, giving fans a chance to sign the pledge wall and try the sobriety simulator in person. The agency runs two companion campaigns alongside the core drunk-driving message: Drive High, Get a DUI, aimed at drivers who assume cannabis use will not trigger an impaired-driving charge, and Ride Sober or Get Pulled Over, targeted at motorcyclists. NHTSA data shows 40 percent of motorcycle riders killed in single-vehicle crashes were riding under the influence of alcohol.

What Counts as Impaired Behind the Wheel

Every state sets the legal blood alcohol concentration limit for driving at 0.08 percent for drivers 21 and older, though a first DUI charge can still apply well below that threshold if an officer determines a driver’s ability to operate a vehicle safely is impaired. Commercial drivers face a stricter 0.04 percent limit, and drivers under 21 face zero-tolerance laws in nearly every state, meaning any detectable alcohol can trigger a citation.

Impairment is not limited to alcohol. A growing number of states have adopted per se limits for THC and other controlled substances, meaning a driver can face DUI charges based on a blood test result alone, separate from any alcohol involved. NHTSA’s Drive High, Get a DUI messaging specifically targets the assumption that cannabis, whether from a dispensary or a doctor’s prescription, is safe to use before driving.

Why Labor Day Draws This Level of Enforcement

NHTSA runs a version of this campaign around most major holidays, but Labor Day ranks near the top of the agency’s own crash data. It falls at the tail end of summer, when road trips, barbecues and end-of-season parties overlap with the return to school and work schedules, and it consistently ranks among the deadliest weekends of the year for alcohol-related crashes alongside the Fourth of July and New Year’s.

Past Labor Day weekends give a sense of the toll. Nationwide, 2024’s Labor Day weekend recorded 505 traffic crash fatalities, with 170 of those crashes involving a drunk driver, a rate that mirrors the roughly one-in-three share alcohol impairment holds across all US traffic deaths for the full year. NHTSA and state police agencies point to that concentration as the reason enforcement resources shift so heavily toward the three-day stretch rather than staying level year-round.

The economics of enforcement also play a role. Overtime patrol funding for many state Drive Sober campaigns comes through NHTSA highway safety grants distributed to state agencies, which concentrate spending around the handful of holiday weekends the data shows carry the highest risk rather than spreading a fixed budget evenly across the calendar.

Ignition Interlock and Repeat-Offender Laws

A parallel trend running through 2026’s state legislative sessions has pushed several states toward mandatory ignition interlock devices, breathalyzer units wired into a car’s starter that require a clean breath sample before the engine turns over, for a wider range of DUI convictions than in past years. Some states now require interlocks after a first offense rather than reserving them for repeat offenders, and a handful have introduced restricted “red-stripe” or comparably marked licenses that flag a driver’s DUI history to any officer who checks the plate or license at a routine stop.

States have also lengthened administrative license suspensions tied to chemical-test refusals, separate from any criminal DUI conviction. A driver who refuses a breathalyzer at a traffic stop can lose driving privileges through the state’s motor vehicle agency without a court ever convicting them of DUI. Implied-consent laws treat holding a driver’s license as tied to an agreement to submit to testing if an officer has reasonable cause to suspect impairment.

What Drivers Should Do This Weekend

Anyone planning to drink over the holiday weekend should arrange a sober ride home before heading out, whether that means a designated driver, a ride-hailing app or public transit where it is available. NHTSA’s core message stays the same every year: plan the ride home before the first drink, not after.

Drivers who spot someone they believe is driving impaired can call 911 and report the vehicle’s location, direction of travel and license plate if it is safe to do so. Anyone stopped at a sobriety checkpoint should have a license, registration and proof of insurance ready. Checkpoints typically move drivers through quickly when paperwork is in order.

Employers hosting Labor Day gatherings, and hosts of any holiday party involving alcohol, can reduce risk by arranging ride-hailing credits or a designated-driver rotation ahead of time rather than leaving guests to sort out a ride home at the end of the night.
